Restatement Hopefuls

You’re probably already familiar with Restatements, those helpful commentaries on American law published by the American Law Institute. Currently ALI boasts over a dozen Restatements, covering general topics such as torts, contracts, and property, and more specialized ones like unfair competition, suretyship and guaranty, and the law governing lawyers. Waiting to join the ranks of full-fledged Restatements are the restatement projects – restatement wannabes, still working their way through the draft stages of writing. They’re a promising lot, and many of them revise and update existing Restatement topics. A few include:

  • Restatement Third, Torts: Liability for Physical and Emotional Harm
  • Restatement Third, The U.S. Law of International Commercial Arbitration
  • Restatement Third, Employment Law
  • Restatement Third, Restitution and Unjust Enrichment

You can often find published tentative drafts of Restatement revisions. Keyword searching Scholar for “restatement and draft” pulls up several.
