DOJ Extends Compliance Dates for Web Content & Mobile App Accessibility

computer monitor displaying the words "website accessibility" and icons of the five senses above the monitorThe U.S. Department of Justice (DOJ) Civil Rights Division issued an interim final rule (IFR), effective 4/20/2026, revising the regulations implementing Title II of the Americans with Disabilities Act. [See Pub. L. 101-336, 104 Stat. 327, 7/26/1990 and 89 Fed. Reg. 31320, 4/24/2024.]  The regulations adopted the Web Content Accessibility Guidelines version 2.1 Level AA, and the IFR extends the compliance dates for web content and mobile application accessibility requirements.  The compliance date for state and local government entities with a total population of 50,000 or more has been extended from April 24, 2026 to April 26, 2027.  The compliance date for public entities with a total population of less than 50,000, or any special district government, is extended from April 26, 2027 to April 26, 2028.  Numerous concerns about the original compliance dates had been expressed through correspondence to the DOJ and Office of Management and Budget.  DOJ found these concerns compelling, and determined it “overestimated the capabilities (whether staffing or technology) of covered entities to comply with the rule in the time frames provided.”  Comments on the IFR must be submitted by 6/22/2026.  For more information see the IFR at 91 Fed.
