Ohio’s Marital Rape Exemption Elimination Bill Heads to the Governor’s Desk

Ohio has long been one of just a handful of states that would not prosecute rape that happens within the confines of marriage.  This is set to be changing as House Bill 161 which eliminates this exception has passed both houses of the legislature and is headed to Governor Mike DeWine’s desk for signature.

Law Professor Patricia Falk has written extensively in her career about Ohio’s marriage rape exception.  These and her other writings can be found on Cleveland State’s Engaged Scholarship repository.
