Congressional Think Tank Weighs in on Recreational Marijuana

The Congressional Research Service (CRS) [find out more about this Congressional think tank here, in our prior post]  recently issued a report on recreational marijuana use. The report, State Legalization of Recreational Marijuana: Selected Legal Issues, examines the question of whether “a state [may] authorize the use of marijuana for recreational purposes even if such use is forbidden by federal law.” The legalization of marijuana by Colorado and Washington is analyzed in light of the federal Controlled Substances Act. There is also a brief discussion of the state laws in relation to the Single Convention on Narcotic Drugs, a treaty to which the United States is party.
