Unique E-Discovery Simulation by Tennessee Law Prof.

Professor Paula Schaefer at the University of Tennessee College of Law developed a simulation exercise for e-discovery.  Her independent study students took on the roles of the clients and witnesses involved in a business dispute, and sent emails to each other.  Then her pretrial litigation students advised the clients (the other students) on e-discovery issues, produced responsive documents in an electronic format and prepared privilege logs.   Then they  negotiate with their opponents on discovery disputes.  For more details see the Best Practices for Legal Education blog: Students Play the Parts and Email (and Blog) the Scripts: Creating a Realistic E-Discovery Experience through Simulation and Paula Schaefer, Legal Dispute Simulation Meets Pre-Trial Litigation Simulation: An Integrated Approach to Teaching E-Discovery Doctrine, Practice Skills, and Professionalism, available at http://ssrn.com/abstract=1676976.

CALI offers simulation software which can be used to do simulation exercises like Professor Schaefer’s E-Discovery simulation.  For more information, see Simulations in the Classroom & in Teaching: Using SIMPLE (SIMulated Professional Learning Environment) , which contains a video of a presentation from the CALI conference and more information.
